They are your clients. They have already agreed to mediation. You write their parenting plan: by the end of the lesson you'll have 6 clauses.
Fun fact: in Colombia animals are "sentient beings" (Law 1774 of 2016). In most of the US a pet is still "property", although Alaska, Illinois and California already let the judge consider its well-being.
Read it carefully: every clause comes from this information.
Andrés, 42
Paula, 39
Sofía, 8
Lupe, 6
Already agreed: joint legal custody and mediation before going to court.
A parenting plan answers three questions. It is always decided with one test: the best interests of the child.
Custodia legalLegal custody
¿Quién decide?Who decides?
Colegio, salud, religión, viajes fuera del país.School, health, religion, travel abroad.
Andrés y Paula: compartidaAndrés and Paula: joint
Custodia físicaPhysical custody
¿Dónde vive y dónde duerme?Where does she live and sleep?
The home from Monday to Thursday, the routine, a school nearby.
Cláusula 1Clause 1
Visitas y alimentosParenting time and support
¿Cuándo ve al otro padre y quién paga? When does she see the other parent, and who pays?
Fines de semana, vacaciones, colegio, natación.Weekends, holidays, school, swimming.
Cláusulas 2, 3 y 5Clauses 2, 3 and 5
Parenting time and support are separate: if one parent doesn't pay, the other cannot take away parenting time.
With a Hispanic client, just say custodia. "Cuota alimentaria" is the Colombian word; in Mexico and Central America they say "pensión alimenticia".
A parenting plan doesn't describe what happens: it says what will happen and on what condition. For that we use some conjunctions. What comes after them isn't a fact yet, so it goes in the subjunctive.
It's the same idea as English so that, as long as, unless, without: they talk about something that hasn't happened yet. Spanish marks that on the verb.
| para que | so that | Andrés recogerá a Sofía el viernes para que pasen el fin de semana juntos. |
| siempre que | as long as | La tía Carmen puede recogerla, siempre que Paula la autorice. |
Trampa 1 · «siempre que»Trap 1 · "siempre que"
+ subjuntivosubjunctive = as long as
In an agreement you almost always want the first one: a condition.
English has whenever and as long as; Spanish uses "siempre que" for both, and the verb shows the difference. And if in English you say in order to, in Spanish it's almost always para + infinitive.
1 fórmula · 2 futuro (la obligación) · 3 conjunción · 4 subjuntivo1 formula · 2 future (the obligation) · 3 conjunction · 4 subjunctive
The contract shall in English is the Spanish future: The child shall reside… → "Sofía residirá…". You don't need "deberá" in every line.
Toca la conjunción que completa cada cláusula. Solo una funciona.Tap the conjunction that completes each clause. Only one works.

The parties agree that Sofía shall reside with her mother from Monday to Thursday, unless the mother is traveling. That week she will stay with her father and, on the nights he works, with Aunt Carmen.
The father shall have Sofía from Friday to Sunday so that they spend the weekend together, and he will take her to swimming on Thursdays, as long as he isn't on shift. In May and November, Sofía will study at her mother's house.
During the December holidays, the mother may take Sofía to Bogotá, provided that she gives 30 days' notice and the father signs the consent. Neither party shall leave the country with Sofía without the other's written authorization.
No me parece razonable porque…Think of the best interests of the child and the family file. Choose and explain out loud why: Me parece razonable siempre que… / No me parece razonable porque…

Andrés
«Quiero que Sofía siga en natación, aunque cuesta $120 al mes.»"I want Sofía to keep swimming, even though it costs $120 a month."
Most likely: reasonable. It keeps Sofía's routine; who pays is still to be decided.
Paula
«No quiero que la tía Carmen recoja nunca a Sofía.»"I never want Aunt Carmen to pick Sofía up."
Most likely: not reasonable, unless there's a serious reason: Carmen lives 5 minutes away and helps during the travel week.
Module 6: aunque + indicative = a fact we know. Aunque + subjunctive = a hypothesis or something we don't know yet.
Aciertos:Correct: 0 / 3
Ahora tú, en voz alta: «Aunque Paula viaje mucho, …» y «Aunque Lupe ladra toda la noche, …»Now you, out loud: "Aunque Paula viaje mucho, …" and "Aunque Lupe ladra toda la noche, …"
The parties agree that Lupe shall live with Sofía so that she can keep sleeping with her. She may go to the father's apartment on weekends, as long as she doesn't stay there more than three nights in a row.
The father agrees to pay 60% of school and swimming, and the mother 40%, so that Sofía can continue with both. Lupe's costs shall be split in half, unless the parties agree otherwise in writing.
In case the parties disagree, they shall go to mediation before going to court. Neither party shall change Sofía's school or city without the other's approval.

Explain it in simple words, without technical terms. 3. Answer the 3 questions Paula asked her lawyer (Camilo reads them).
1«¿Custodia legal compartida quiere decir que Sofía vive mitad y mitad?»"Does joint legal custody mean Sofía lives half and half?"
It means you both make the important decisions together. Where Sofía lives is a different thing: clause 1.
2«Si Andrés no paga un mes, ¿puedo no llevarle a Sofía ese fin de semana?»"If Andrés doesn't pay one month, can I keep Sofía from him that weekend?"
No. Parenting time and support are separate. If he doesn't pay, you tell me and we claim it, but Sofía keeps seeing her dad.
¿Me puedo llevar a Sofía y a Lupe?»"And if I get a job in Bogotá? Can I take Sofía and Lupe with me?"
Primero iríamos a mediación (cláusula 6).Not without Andrés signing or a judge authorizing it. First we would go to mediation (clause 6).
